Understanding Transgender Issues in the Workplace

Transgender employees often face particular challenges in the workplace that, for unprepared employers, can be both difficult to navigate and potentially expose them to legal liability. Legal protections for transgender workers are expanding. Government contractors and subcontractors are prohibited from discriminating against transgender persons; various state and local laws provide similar anti-discrimination protections for transgender employees; and although federal law does not explicitly protect transgender employees, numerous federal courts have held Title VII's prohibition of sex discrimination extends to transgender employees. Employers must be prepared to address the issues facing transgender employees, including implementing appropriate policies, procedures, and education for their workforce.
